Subject to your compliance with these terms, Harry Whitwell grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Sidekick app for your personal use only. You agree not to use the app for any commercial purposes.
You are solely responsible for any content that you create, upload, or transmit through the app, including text, images, and other media. You agree that Harry Whitwell has the right to use, modify, adapt, and distribute your content for the purpose of providing and improving the app.
The Sidekick app and all content and materials contained therein, including but not limited to trademarks, logos, images, and software, are the property of Harry Whitwell and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the app or any content therein.
We value your privacy and are committed to protecting your personal information. Our Privacy Policy outlines our data collection and usage practices. By using the Sidekick app, you consent to the terms of our Privacy Policy.
We may terminate your access to the Sidekick app at any time without notice or liability, for any reason whatsoever, including but not limited to your breach of these terms.
THE Sidekick APP IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. Harry Whitwell DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Harry Whitwell DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
IN NO EVENT SHALL Harry Whitwell BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS AND DAMAGES ARISING FROM YOUR USE OF THE Sidekick APP.
These terms shall be governed by and construed in accordance with the laws of New Zealand. Any legal action or proceeding arising out of these terms shall be brought in the courts of New Zealand.
We reserve the right to modify these terms at any time without prior notice. Your continued use of the Sidekick app after any such changes constitutes your acceptance of the new terms.
